General Terms and Conditions of Sale
The micro-enterprise “Atika Jewelry” is engaged in the sale of stainless steel jewelry (hereinafter referred to as the "product(s)").
These General Terms and Conditions of Sale define the rules applicable to the sale of jewelry through the website www.atika-jewelry.com (hereinafter referred to as the "site"), registered under the SIREN number 931684153, and whose headquarters is located in Toulouse.
“Atika Jewelry” and the Customer are individually referred to as "a Party" and collectively as "the Parties".
The acceptance of these General Terms and Conditions of Sale (“T&Cs”) implies the full and unconditional adherence of the Customer to these T&Cs.
All orders on the site are subject to these T&Cs. They may be modified and updated; the conditions applicable to the order of a product by a Customer are those in effect on the day of the order.
Article 1: Acknowledgment and Acceptance of the T&Cs
These T&Cs are available on the site and during the order process.
The T&Cs form the legal basis for contracts concluded between the Customer and “Atika Jewelry”. They override any conflicting clauses, whether printed or not, proposed by the Customer, unless they have been explicitly and expressly accepted by “Atika Jewelry”.
By placing an order for a product on the site, the Customer declares that they have read and accepted these T&Cs in their entirety without any reservation.
Article 2: Information on Orders
2.1. Conditions for Placing an Order
The Customer must be at least 18 years old or have parental authorization to place an order. They must also ensure the accuracy and completeness of their personal data when registering on the site. In case of an error in the recipient's contact information, “Atika Jewelry” will not be responsible for the inability to deliver. “Atika Jewelry” reserves the right to cancel any order if the customer's IP address differs from the billing and/or delivery address.
2.2. Information on Products
In accordance with articles L. 111-1 and following of the French Consumer Code, the Customer may consult, before placing an order, the essential characteristics of the products on the site.
“Atika Jewelry” commits to providing clear information on each product, including its use, properties, and expected results. However, although “Atika Jewelry” takes great care in ensuring the accuracy of the available information, it cannot be held responsible for errors or omissions in the descriptions provided by the manufacturers and designers.
The photographs and graphics of the products are indicative and do not have contractual value.
If a product delivered does not match its description, the Customer may exercise their right of withdrawal or invoke the conformity guarantee of “Atika Jewelry”, which may exchange the product, refund the price (in whole or in part), or issue a credit valid for one year on a future order.
“Atika Jewelry” advises the Customer to check the product descriptions for their precise characteristics and to contact them at support@atika-jewelry.com for any questions before placing an order.
If a product does not comply with current legislation or presents a safety risk, it may be withdrawn or suspended from the site by “Atika Jewelry”. Products are available subject to stock availability.
2.3. Order and Payment
Any order implies the full and unconditional acceptance of the Customer to the T&Cs. Once the products are selected, the Customer must verify the contents of their cart, then validate the order by checking the summary (price, taxes, delivery fees, billing, and payment information).
The Customer must provide the necessary information for processing the order, including their identity, contact details, and payment information. If the Customer refuses to provide this information, “Atika Jewelry” will not be able to process the order.
The prices are those indicated at the time of the order, all taxes included. The Customer can pay by PayPal or credit card. By paying, the Customer guarantees that they are authorized to use the card and that there are sufficient funds.
By validating the order, the Customer confirms their purchase, and the confirmation by email validates the sales contract. Delivery of the products occurs after receipt of payment, with shipping within 5 business days. In the absence of specific instructions, “Atika Jewelry” will deliver within a maximum of 30 days after the order has been validated.
Article 3: Product Availability
Product offers are valid within the limits of available stock. In case of total or partial unavailability of products after the order, “Atika Jewelry” will inform the Customer by email of partial delivery or order cancellation.
If a product is unavailable, the Customer may choose between:
- Receiving a product of equivalent quality and price,
- Being refunded the price of the ordered product by exercising their right of withdrawal,

In all cases, the delivery fees for a new product will be covered by “Atika Jewelry”.

Article 4: Financial Conditions
4.1. Price
The prices of the Products on the Site are displayed in euros (€) including all taxes, with the applicable delivery charges clearly indicated before the order is validated. These prices include VAT at the prevailing rate, and any change in the rate may affect the price of the Products.
The prices are fixed and non-negotiable. "Atika Jewelry" will proceed with delivery only if the total price has been fully paid. Delivery charges are clearly indicated before the order is validated.
The Client is informed that they may be subject to customs duties or import taxes depending on the country or overseas department of delivery, which are their responsibility. The Client is encouraged to inquire with local authorities. The total price, including taxes and shipping costs, is indicated in the cart and must be paid in full at the time of the order.
4.2 Payment – Terms
The payment for the Order is made at the time of placing the order, by credit card or PayPal transfer via the Site. "Atika Jewelry" may cancel the Order without notice in case of non-payment, fraudulent payment, or attempted fraud. Additionally, "Atika Jewelry" reserves the right to implement a payment verification system. The Client must follow this verification procedure; if not adhered to, the Order will be considered null and void.
Article 6: Delivery
6.1 Origin and Destination
The Products may be delivered worldwide. The Products are shipped to the delivery address provided by the Client during the Order process.
6.2 Delivery Time
“Atika Jewelry” commits to doing its best to deliver the Products quickly. Orders in stock are prepared within 2 to 7 days (excluding weekends), except in case of high demand.
The delivery times are indicative, and “Atika Jewelry” cannot be held responsible for delivery delays that are not its fault. These times may be changed due to unforeseen events, and “Atika Jewelry” will make an effort to keep the Client informed of any delay. In the case of delivery by "tracked letter" or "parcel," “Atika Jewelry” disclaims any responsibility for parcels confirmed as delivered by the carrier and will not provide any refund or credit for these parcels.
6.3 Delivery Conditions
To ensure fast delivery, the Client must provide a correct postal address and a valid mobile phone number.
“Atika Jewelry” and the carrier cannot be held responsible for delays or delivery issues if the Client does not provide a functional phone number, does not respond to the carrier's requests, or if the information provided is inaccurate or imprecise.
6.4 Delivery Fees
The delivery fees are the responsibility of the Client and vary depending on the delivery method and destination. These fees are in addition to the price of the Products. The details of the delivery times and fees are specified on the Site during the Order process.
6.5 Verification of Received Product and Non-Conformity
Before opening the packaging, the Client must check that the package is in good condition. Any reservation should be reported to “Atika Jewelry.”
Claims regarding the non-conformity of the Product must be made in writing and with supporting photos, by email to support@atika-jewelry.com, as soon as the Products are received.
In case of non-conformity, “Atika Jewelry” commits to offering a solution for repair or replacement. The return shipping costs for the non-conforming Product will be covered by “Atika Jewelry,” provided the product is not damaged beyond the non-conformity defect and is returned in its original packaging. The Client must return the Products within 14 days from the claim, to the address provided in the return email.
The Client must provide evidence of the non-conformity of the Product to benefit from an exchange or a new delivery.
Article 7: Withdrawal
The Client has 14 days from the receipt of the Product to exercise their right of withdrawal, without justification or penalties, in accordance with Article L.221-18 of the Consumer Code. If the deadline expires on a non-business day, it is extended until the first following business day.

It is recommended to use the following wording to notify the withdrawal:

The Client must return the Products within 14 days from the notification of their withdrawal, to the address provided in the return email.
The Products must be returned complete, in perfect condition, and in their original packaging to allow their resale. It is advisable to mention the order number on the return package.
“Atika Jewelry” reserves the right to refuse returns made after the legal withdrawal period. It is also recommended to return the Products in the same conditions as those of the initial shipment, with a declared value corresponding to the order, and to keep proof of shipment.
If the right of withdrawal is properly exercised, “Atika Jewelry” will refund the total amount paid, including standard delivery charges, within 14 days following the notification, subject to receipt of the returned Products or proof of shipment.
The refund will be made using the same payment method as the one used for the order, unless otherwise agreed by the Client, and without any charges for the Client.
Article 8: Retention of Title
“Atika Jewelry” retains full ownership of the Products sold until full payment of the price. However, the risks of loss or deterioration of the Products are transferred to the Client as soon as the delivery is made.
Article 9: Personal Data
The information requested from the Client is necessary for the processing of the Order and the delivery of the Product. For more information or to exercise their rights, the Client is invited to consult the Privacy Policy available on the Site.
Article 10: After-Sales Service
For any questions, complaints, or requests regarding the General Terms and Conditions of Sale or the Products, the Client may contact the After-Sales Service of “Atika Jewelry” by specifying, if necessary, their order number, by email at the following address: support@atika-jewelry.com or by filling out the contact form available on the Site.
Article 11: Force Majeure
“Atika Jewelry” shall not be held responsible for the non-performance of its obligations in the event of a force majeure event, as defined by law and jurisprudence.
Force majeure events include any unforeseeable, irresistible, and external event to the will of “Atika Jewelry”, including strikes, interruptions in transport, supply of energy, raw materials, or products from suppliers.
Article 12: Intellectual Property
The elements on the Site (pages, texts, logos, graphics, videos, photographs, trademarks, etc.) are protected by intellectual property rights, such as copyright, image rights, trademark rights, and database rights. “Atika Jewelry” or the creators of the referenced Products hold these rights.
Using the Site does not confer any rights to these elements. Any reproduction, modification, distribution, or transfer of these contents without prior written authorization from the holders of the rights constitutes an infringement subject to legal action.
